Terms and Conditions:
Terms and Conditions
These terms and conditions ("Terms") govern the provision of compliance paperwork services ("Services") offered by Fragrance and Flavour Blends UK ("Provider") to individuals or businesses ("Customer") in the fragrance or flavour industry. By engaging our Services, the Customer agrees to abide by these Terms.
1. Accuracy of Paperwork
The accuracy of completed paperwork, including Safety Data Sheets, Allergen Declarations, IFRA Certificates, and CLP Labels, is contingent upon the accuracy of the documents provided by the fragrance supplier to the Provider. The Provider shall not be held responsible for errors in completed paperwork caused by inaccuracies or issues with the original documents supplied by the fragrance supplier.
2. Document Validity
Documents provided to the Customer are accurate at the time of printing. Any changes to the individual fragrances used in the blend, or to the associated paperwork for those fragrances, will render the completed blend paperwork void. In such cases, the Customer must purchase new paperwork. It is the Customer's responsibility to monitor their fragrances and identify any reformulations that may affect their blend.
3. Confidentiality
Any blend creations shared with the Provider, whether or not the Provider is hired to complete the work, will be treated as confidential and will not be shared with any third party without the Customer's explicit consent.
4. Payment
Payment for Services must be made in full before the completion and provision of paperwork. The Provider reserves the right to withhold Services until payment is received.
5. Product Labelling
The Provider will provide a full breakdown of the recommended wording for product labelling, including regulatory requirements. It is strongly advised that the Customer includes all recommended regulatory wording on their product labels. Any decision by the Customer to remove or alter regulatory wording is made at their own risk, and the Provider shall not be liable for any consequences thereof.
6. Legal Compliance and Reworks
If the requested blend cannot legally be sold due to creating a hazardous end result, the Provider will offer three reworks of the paperwork. During these reworks, the Customer may amend their blend percentages to attempt to achieve a legally compliant blend.
-
If after three reworks the blend remains non-compliant, no refund will be offered, and the Customer will be required to purchase new blend paperwork.
-
The Provider reserves the right to refuse further reworks if it is deemed that achieving legal compliance is not feasible.
7. Accuracy of Paperwork and Percentage Variations
The provided paperwork will be accurate only when the Customer continues to use the exact percentages and materials specified in their blend or recipe request. Any changes made by the Customer to the percentages of oils or materials used in the blend or recipe will render the provided paperwork null and void. In such cases, the Customer must notify the Provider and purchase new paperwork reflecting the updated percentages.
8. Software License Maintenance
The Provider agrees to maintain a valid license to professional-grade software required to complete paperwork requests, ensuring the best chance of delivering an accurate end product. In the event that the Provider discontinues purchasing the license for this software, document authoring services will cease immediately until such time as the license is reinstated.
9. Flash Point Information
Where Flash Point is concerned, the software used by the Provider will generate a "best guess" value based on the Flash Points of all materials included within the recipe or blend.
-
The Customer acknowledges and accepts that this figure is indicative only and may not represent the definitive Flash Point of the finished product.
-
To obtain an accurate Flash Point, the Customer must undertake closed or open cup testing at their own cost and responsibility.
-
Should the Customer conduct such testing, they must inform the Provider of the confirmed Flash Point of the finished product before paperwork is generated, so that accurate data can be reflected.
10. Governing Law
These Terms are governed by the laws of the United Kingdom. If any dispute arises in connection with these Terms or our Services, it will be resolved under UK law and heard only in the UK courts. We will always do our best to resolve any concerns or issues with you directly before considering formal legal action.
By engaging our Services, the Customer acknowledges that they have read, understood, and agreed to these Terms and accepts full responsibility for compliance with all applicable laws and regulations.
